Of all the many matters you should consider during the busy and special time before your marriage, will be how you and your soon-to-be-wed partner will arrange your financial affairs. An important part of this process is entering an ante-nuptial contract.

Most couples decide on this option because the alternative is a compulsory pooling of assets into a joint estate where each party co-owns a half share.With an ANC, each party retains what they have instead. They can still co-own individual assets (eg the family home) if they want to. In practice, this is generally a far more practical and flexible arrangement.

Darrolls Attorneys seeks to minimise the inconvenience and effort involved in signing an ANC. The way we work is that, upon your enquiry, we will send you some material and a form that requests from you the information we need to draft your contract. This enables us to have the contract ready for you when we meet. We then attend immediately to changes, if any, before signature. We will also provide you with information on making a will. It is important that you consider making a will at this stage of your lives, especially if you don’t have one already. Whether you decide to do so or not is up to you, but it is so important to have a will that we feel professionally obliged to draw your attention to it.

Please do not forget to bring your ID books (or other proof of identity) and proof of residence (utility bill, bank statement etc) so that we can comply with FICA (the South African anti-money-laundering statute).
